1. Acceptance of Terms

By accessing or using VibeCord ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

VibeCord is a platform that enables users to create, deploy, and manage Discord bots through natural language conversations. The Service includes AI-powered code generation, hosting, and management tools for Discord bots. Unless we explicitly state otherwise in writing, you remain the operator responsible for the Discord application, bot configuration, moderation behavior, and policy compliance of any bot you publish with the Service.

3. Account Registration

To use certain features of the Service, you must register for an account using Discord OAuth. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Create bots that violate Discord's Terms of Service or Community Guidelines
  • Engage in spamming, harassment, or any form of abuse
  • Distribute malware, viruses, or other harmful code
  • Collect user data without proper consent
  • Impersonate other users, bots, or organizations
  • Circumvent rate limits or abuse the Service infrastructure
  • Operate bots that dox, phish, steal credentials, facilitate account takeover, or automate unwanted direct messages
  • Operate bots that handle or distribute illegal sexual content, sexual exploitation of minors, or child-safety abuse
  • Operate bots for financial scams, deceptive payment flows, rug-pulls, or payment-network abuse
  • Create bots for illegal purposes or to facilitate illegal activities

5. Subscription and Payments

Some features require paid purchases, managed hosting fees, or other usage-based charges. If we offer a temporary demo runtime or other shared evaluation environment, it is provided for limited evaluation only and is not an assured production path. We may change pricing, packaging, or purchase options with reasonable notice where required by law.

If your bot offers paid capabilities directly to Discord users in regions where Discord requires Premium Apps support for those offerings, you are responsible for complying with Discord's monetization requirements, including any price-parity or in-client purchase requirements that apply to your app.

Refunds, Founding-150 lifetime entitlement, and chargeback handling are governed by the Refund Policy. If the Service has a major problem, nothing in these Terms limits any non-waivable rights you have under Australian Consumer Law or other consumer law that applies to your purchase.

6. Discord Platform Compliance

You must operate any bot created with the Service in compliance with Discord's Terms of Service, Community Guidelines, Developer Terms of Service, Developer Policy, and related documentation. This includes complying with Discord rate limits, respecting user permissions, and avoiding spam, harassment, deceptive flows, credential collection, or unlawful activity.

If your bot depends on privileged intents or grows toward Discord's review thresholds, you are responsible for completing the required Discord-side configuration, review, or verification steps. Discord's current guidance allows privileged-intent application flows at 75 or more servers and requires app verification to scale past 100 servers.

7. Intellectual Property

You retain ownership of the bot configurations and customizations you create. The underlying platform, AI models, templates, and Service infrastructure remain the property of VibeCord. Generated code is licensed for your use in connection with the Service.

8. Service Availability

We strive to maintain high availability but do not promise uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for any downtime or service interruptions beyond our reasonable control.

9. Termination

We may suspend, pause, disable, remove, or terminate your account, generated bots, deployments, tokens, hosting, or access immediately if we believe you or a workload you operate violates these terms, Discord policy, applicable law, payment-network rules, or creates legal, security, safety, reputation, or infrastructure risk. You may cancel your account at any time. Upon termination, your bots will be stopped and your data will be deleted or retained in accordance with our data retention, legal, security, and evidence preservation obligations.

10. Limitation of Liability

To the maximum extent permitted by law, VibeCord shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Changes to Terms

We may modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.
